Bioterrorism New!
The Bioterrorism Act of 2002
The events of September 11, 2001, reinforced the need to enhance the security of the United States. Congress responded by passing the Public Health Security and Bioterrorism Preparedness and Response Act of 2002 (the Bioterrorism Act) which President Bush signed into law June 12, 2002. The Bioterrorism Act of 2002 requires that FDA (Food & Drug Administration) receive prior notice of food imported into the U.S. beginning on December 12, 2003. While most of the prior notice of the information that is be required by the rule is common invoice data usually provided by importers or brokers to U.S. customs when goods arrive in the U.S., the Act requires that FDA now receive advance information on import shipments. All foods and beverages whether or not intended for human consumption are subject to the proposed requirements.
Under the prior notice regulation, prior notice of imported foods must be received and confirmed electronically by FDA no more than five days before its arrival and no fewer than:
- two hours before arrival by land via road;
- four hours before arrival by air or by land via rail; or
- eight hours before arrival by water.
The Act also requires owners, operators or agents in charge of domestic of foreign facilities that manufacture, process, pack or hold food for human or animal consumption in the U.S. to register the facility with the FDA by December 12, 2003. The final rules for registration and prior notice under the Bioterrorism Act were published on October 10, 2003.
